A US woman who unintentionally became a surrogate for a stranger’s child filed a lawsuit against a fertility clinic, raising questions about mistakes made by the clinic.

A woman in the United States is suing a fertility clinic after becoming an unwitting surrogate for a stranger’s child after she gave birth to him and later had to give him up to his biological parents, as per NBC News.

After giving birth to a baby boy, 38-year-old Krystena Murray got to know that the newborn was African-American, even though she and her sperm donor were both white. Murray used IVF to conceive two years ago, and in December 2023, she gave birth to a healthy boy.

“I was happy. I was a mom. He was beautiful and perfect, but it was also very clear something was wrong,” Krystena Murray spoke to NBC News about her case against the fertility clinic.

Krystena Murray sought a DNA test after giving birth and found she had no relationship with the child. “My baby is not genetically mine – he doesn’t have my blood, he doesn’t have my eyes, but he is and will always be my son. I will never fully heal or completely move on and part of me will always long for my son and wonder what kind of person he’s becoming,” she added.

The fertility clinic was promptly notified by Krystena Murray, who then told the child’s biological parents. A few months after the child was born, Murray willingly gave up the child, and they began the custody process.

“She vividly remembers the shock when she saw her baby for the first time. Whereas Krystena is a Caucasian woman who chose a sperm donor with a similar appearance, the baby she delivered was African American. Errors like this should never occur in a fertility clinic, this is the cardinal sin,” said Krystena Murray’s lawyer, Adam Wolf as quoted by NBC News. He works as a partner at Peiffer Wolf Carr Kane Conway & Wise, a law company.

Krystena Murray’s case was described by the fertility clinic as an “isolated event with no further patients affected.”

“The same day this error was discovered we immediately conducted an in-depth review and put additional safeguards in place to further protect patients and to ensure that such an incident does not happen again,” a statement by the fertility clinic reads.
