President Donald Trump’s problems regarding America’s H-1B visa are going to increase. The US Chamber of Commerce has filed a lawsuit against the Trump administration’s imposition of a hefty fee of $1 lakh on H-1B visas. The American Chamber of Commerce has said that the huge increase in visa fees is illegal, misleading and extremely harmful for the businesses of the country.
The US Chamber of Commerce filed a federal lawsuit in the District of Columbia Court on Thursday (October 16, 2025). America’s Chambers of Commerce includes big American companies like Microsoft, Walmart, Exxon Mobil, Amazon and Pfizer as members. Regarding the steps taken by President Trump regarding H-1B visa, he said that the Trump administration has encroached on its statutory rights by announcing an increase in visa fees. Along with this, the Chamber has also raised the demand for issuing an immediate injunction to stop the enforcement of the policy.
This lawsuit is targeting Trump’s order
The lawsuit filed by the US Chamber of Commerce in the District of Columbia Court is directly targeting the order given by President Donald Trump last month regarding H-1B visas. Trump’s order was titled ‘Restrictions on Entry of Certain Non-Migrant Workers’, which fundamentally reshapes the H-1B visa program in the US.
According to the new rules after the order of President Trump, now a fee of $ 1,00,000 will have to be paid with new applications for H-1B visa. These rules have been made mainly for the citizens of countries outside America, for which about 70 percent of the people come from India.
Chamber of Commerce gave arguments in the lawsuit
While filing the suit, the American Chamber of Commerce argued in the court that the new fee imposed by the US administration violates the Immigration and Nationality Act (INA) that regulates H-1B visas. Apart from this, this fee increase also violates the decision of the US Parliament, according to which under this visa program, every year 85,000 people should contribute to the development of America according to their talent.
