The Prevention of Cruelty to Animals Act of 1960 prohibits acts such as beating, overloading, neglect or killing animals unnecessarily. The government introduced the Prevention of Cruelty to Animals (Amendment) Bill, 2022, which proposes categorising offences towards animals as minor, severe or gruesome, with harsher penalties, including up to Rs 75,000 in fines and five years of imprisonment for serious offences like mutilation or killing.
The amendment also introduces the concept of the “five freedoms” for animals, ensuring they are free from hunger, discomfort, pain, and fear and can express natural behaviour. The new Bharatiya Nyaya Sanhita (BNS) 2023 also strengthens penalties for maiming or killing animals under Section 325.
