Real Estate Regulatory Authority: A person invests all his savings in buying a house, but when he has to go through hoops to get the house, he is forced to take help of the law. Today we are going to tell you one such story, where a person had to wait for a long time of 10 years for his flat. Whereas he had paid the full amount to the builder. The matter is of Gurgaon. Here a couple booked a flat worth Rs 1.16 crore in the year 2013.
Flat not received despite full payment
First a booking amount of around Rs 12 lakh was paid and in 2014, a sale agreement was signed after the remaining Rs 95 lakh was paid. Later, when both of them went on site visit, they came to know that the work of constructing the flat had not started yet. After this, both of them reached the builder’s office to cancel the booking and get the refund. The builder somehow prevented him from canceling the booking and asked him to invest the money on another flat in his own project at a cost of Rs 1.55 crore. However, the work on this flat was also not completed on time. Both of them again contacted the builder to cancel the booking. This time also he was persuaded to invest in some other flat in exchange of refund.
Customer lodged complaint with RERA
This was the third time after 2013 that despite paying Rs 1.07 crore, he was not given a single flat. When the builder could not deliver the flat even on the scheduled date of July 21, 2022, the patience of both of them finally broke and a complaint was filed against the builder in Haryana RERA. Along with canceling his booking, he also demanded return of Rs 1.07 crore along with interest as compensation. Haryana RERA, while giving its verdict under Section 2(za), Rule 15, Section 18(1), ordered payment of Rs 2.26 lakh to the builder. This included a refund of Rs 1.07 crore and 11.1 percent interest.
What is RERA?
Let us tell you that the Real Estate (Regulation and Development) Act 2016 (RERA / RERA) is a law which has been made keeping in mind the interest of the customers. Under this, if the builder delays in giving possession, then the consumer has the right to cancel the booking and ask for refund. In this, complaints can be filed against promoters and real estate agents.
